Possession of Marijuana Under 50 grams/hashish under 5 grams

Possession of Marijuana under 50 grams is a very common charge filed by local, county and state police. The statute is N.J.S.A. 2C:35-10a(4), and while this charge is considered a disorderly persons offense (not a crime) the potential for serious and life changing sanctions does exist. The potential penalties if found guilty are:

• Up to six months in the County Jail;
• Up to a $1000.00 fine and approximately $800.00 in mandatory fees and assessments;
• Potential six (6) month loss of their driver’s license;
• Probation and/or community service.
